Terms and Conditions (Account and Service Users)

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the www.careerecology.com website (the “Service”) operated by Irvington Group (“us”, “we”, or “our”).  

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

Communications

By creating an Account on our service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

Payment

Paying Customers will make any applicable payments for Services in accordance with their respective Customer Agreements. All payment procedures will be provided through the Site.  In such an event, the following terms shall apply. If you have provided Irvington Group (or any affiliated third party agents used to process payments) with your credit or debit card for payment, all charges that you incur for access to and use of the services will be applied to the credit or debit card number you provide to us. You are responsible for providing and updating all credit or debit card information required for Irvington Group or any affiliated third party agents to apply valid charges to the card. Irvington Group or our agents may take commercially reasonable actions to validate your credit or debit card. If payment is not received by us or our agents from your credit or debit card issuer or its agents, you agree to pay all amounts due upon demand by us or our agents. If you fail to pay any amount payable hereunder when due, you agree to pay, in addition to any amount past due, interest accrued thereon, and all reasonable expenses incurred by Irvington Group and our agents in enforcing these Terms and Conditions, including, but not limited to, all expenses of any legal proceeding related thereto and all reasonable attorneys’ fees incurred in connection therewith. Notwithstanding anything to the contrary contained herein, in the event you have not paid any invoice amount by its due date, or should your credit or debit card number expire, or should Irvington Group otherwise be unable to apply valid charges to the card number, Irvington Group, at its sole option and without any liability to you or any third party hereunder, shall have the right to suspend all services until such time as all unpaid amounts have been paid. All payments are non-refundable, except as otherwise expressly provided herein.

Fee Changes

Irvington Group, in its sole discretion and at any time, may modify the fees for the Membership Services.

Irvington Group will provide you with a reasonable prior notice of any change in fees.

Your continued use of the Service after the fee change comes into effect constitutes your agreement to pay the modified fee amount.

Refunds

Certain refund requests for Service fees may be considered by Irvington Group on a case-by-case basis and granted in sole discretion of Irvington Group.

Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting Content on or through the Service, You represent and warrant that: (i) the Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. We reserve the right to terminate the account of anyone found to be infringing on a copyright.

You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third party posts on or through the Service. However, by posting Content using the Service you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You agree that this license includes the right for us to make your Content available to other users of the Service, who may also use your Content subject to these Terms.

Irvington Group has the right but not the obligation to monitor and edit all Content provided by users.

In addition, Content found on or through this Service is the property of Irvington Group or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.

Accounts

When you create an account with us, you guarantee that you are above the age of 18, a legal resident of the United States (this service is not intended for use outside the United States), and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

 

Intellectual Property

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Irvington Group and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. 

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Irvington Group.

Links To Other Web Sites

Our Service may contain links to third party web sites or services that are not owned or controlled by Irvington Group.

Irvington Group has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that Irvington Group shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third party web sites or services that you visit.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your engagement, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Indemnification

You agree to defend, indemnify and hold harmless Irvington Group and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

 

Limitation Of Liability

In no event shall Irvington Group, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

 

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Irvington Group its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

 

Governing Law

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

Terms and Conditions (Certification Users)

 

As a Feng Shui Resume Writer (FSR), I agree: 

 

I. The Integrity of Feng Shui Resume

 

I will not take aspects of, language from, or concepts of FSR and “rename” or “repackage” them as my own system or approach. I will not modify, amend or deviate from FSR language and concepts.

 

A) I may publicly use the FSR after I have successfully completed a Feng Shui Resume Certification Training, I am a current member in the Career Ecology Network, and am in good standing with Career Ecology. 

 

B) I will hold in fidelity the intention, methods, language and graphic style of FSR. 

 

C) I will maintain the FSR template and styling in its entirety. 

 

II. Cultural Diversity and Sensitivity 

 

A) I recognize that FSR may be offered throughout the world to many people of different ethnic backgrounds, gender, social class, language and other factors. All are invited without any discrimination to express their inner genius via the FSR.

 

B) Career Ecology is committed to confronting its own bias and values and building a more just and equitable place of learning and personal growth. Career Ecology recognizes the history of oppression that resulted in ongoing disparities for communities and that Career Ecology has a unique ability to create positive systemic change via the mindful work of authentic relating. 

 

C) Career Ecology recognizes that intention alone will not change things and all of us must be committed to transforming our own biases, values and opinions. 

 

D) As a Certified FSR writer I acknowledge that my words, actions, and energy must reflect cultural inclusion and respect at all times during the certification and as an FSR writer. 

 

III. Copyright, Registered and Trademark Rules 

 

I will comply with all federal and state copyright, registered and trademark laws in nonpublished work as follows: 

 

A. Feng Shui Resume™ - The trademark symbol (™) must be used the first time the words “Feng Shui Resume” is used in the body copy. It is not necessary to repeat the mark after that. It may be inserted in the most prominent use of the words as well, like the title of the document or headline of the article. The correct formatting is: Feng Shui Resume™ 

 

B. In any published material, I will request permission from Feng Shui Resume through its Formal Review Process before publishing FSR terminology or techniques. 

 

C. I will not use the words “Feng Shui Resume” or “Feng Shui Resume Writer” in the actual name of my business, website or social media page. As long as my training certification is in good standing I may use “Feng Shui Resume” or “Feng Shui Resume Writer” in the tag line or description of my business. 

 

D. I will not use the FSR logo, aspect of its design or exact colors to represent my own business or any published work. I will create a separate logo that will not create “brand confusion” between my business and the official FSR logo. 

 

E. I may use the Feng Shui Resume Writer logo when I am promoting opportunities that are purely FSR in nature and never while also presenting any other methodologies. 

 

F. When using FSR, I will properly credit Lori Wallace and Career Ecology when appropriate or requested to do so by Career Ecology. 

 

VI. Miscellaneous 

 

All of the terms and conditions of the Feng Shui Resume Policies and Procedures which are attached hereto are incorporated herein as if fully set forth. 

 

I agree to honor all of the terms and conditions in the FSR Agreement. 

 

The terms and conditions in the FSR Agreement and the Feng Shui Resume  Policies and Procedures shall be governed and interpreted by the laws of the State of California, USA, and all disputes arising therefrom shall be addressed within the venue forum and jurisdiction of San Diego County, California. The prevailing party shall have the right to collect from the other party its reasonable costs and attorney’s fees incurred in enforcing this Agreement. 

 

I have read the entire Feng Shui Resume Writer Agreement and Feng Shui Resume Policies and Procedures and agree to be bound by all of the terms and conditions therein and any future amendments or modifications thereto.  I acknowledge that by participating in the Feng Shui Resume Certification Training, I am affirming my agreement with the terms and conditions provided in this document.

Q: What is the Feng Shui Resume (FSR)? 

 

A: Feng Shui Resume is a progressive template and style of resume writing that takes into account the needs of both the individual and the reader.  FSR promises an experience and outcome that delivers on authentic expression and professional storytelling in a manner that is professional and engaging; in a manner that facilitates understanding among readers and energizes the contact. The FSR was crafted by Lori Wallace after twenty years of executive search experience (serving entry level to CEO) and serves the deepest need of connection to self and the world around us.


 

Q: Why do I need to sign the FSR Agreement? 

 

A: Career Ecology is offering a channel to individuals to lift up their voice within the professional space of resume which makes Feng Shui Resume Writer™ as a pathway critical in its clarity and final outcome. Therefore, FSR methodologies must be consistent and reliable. Career Ecology intends to provide this consistent and reliable framework for FSR students and writers worldwide. 

 

Q: What are the different FSR Certifications? 

 

A: FSR Certified writer: any individual who has successfully completed the Certification Training, paid the fee,  and has been awarded a certificate of completion by Feng Shui Resume.  Note: the fee is waived for students engaging in training prior to January 1st, 2023.

 

Q: What are the benefits of becoming a FSR writer? 

 

A: Only FSR writers who are certified and in good standing are eligible to publicly use the FSR method with clients. They also are exclusively invited to join the Career Ecology Ecosystem of Resume Writers where they may offer FSR or other services per the request of the client.

 

Non-certified individuals may only share their enthusiasm for FSR and success stories. They may not: 1.) utilize the template or training methodology with clients or for any business or personal purposes; 2) publicly market or advertise information about FSR facilitated by a non-FSR writer; and 3) represent themselves in any way as a person who has expertise or professional competency in FSR. 

 

Q: How do I stay FSR certified? 

 

A: To maintain Certification as an FSR writer, an individual must complete a FSR update training every three (3) years (free of charge) to stay up to date on changes to template, design, services and approach. A lapse in certification will result in the loss of certification. In the event of a lapse, an individual is still continuously bound to uphold the terms and conditions of the FSR Fidelity Agreement and FSR  Policies and Procedures. Q: What must I do as an FSR writer? 

 

A: As an FSR writer, you have a responsibility to: 

 

1. Comply with the FSR Agreement; and 

 

2. Maintain your up-to-date profile on Career Ecology to be available to potential clients seeking a FSR and your individual support;

 

3. Read the FSR writer Update via Career Ecology (sent via email periodically); and 

 

4. Ensure that your email spam filter allows email from Career Ecology by adding lori@careerecology.com to your safe sender list; and 

 

5. Not “opt-out” of any electronic emails sent by Career Ecology ; and 

 

6. Pay for FSR Certification Training (unless you are participating within the first cohort in ending December 31st, 2022). 


 

Q: Are there any exceptions to the three (3) year recertification? 

 

A: Not if you wish to continue to remain part of the Career Ecology community, receive referrals and market the FSR to clients. It is your choice, of course, to discontinue at any time.

 

Q: What should I do if I become aware of somebody who is not certified in FSR publicly or committing another type of Career Ecology breach? 

 

A: If you become aware of such a circumstance in which someone may be in breach of the FSR Agreement, it is your responsibility as a writer to inform Career Ecology or Lori Wallace. Career Ecology will open the door to that person to attend training and officially join the community. Your name will be kept confidential in the process. Q: What is the difference between “non-published” and “published” work? 

 

A. “Non-published” work means all templates, advertisements, handouts, brochures, websites and all noncommercial printed material. It is property “not-for-sale.” 

 

“Published” work means work intended for sale, including but not limited to trainings, books workbooks, videos, and audios.

 

Q: What is the significance of copyright and trademark material?

 

A: The Feng Shui Resume™ is a trademark name and all information and material related to FSR and Lori Wallace and under the guardianship of Career Ecology. Accordingly, it is imperative that every writer follow the methods contained in the FSR Agreement in order to properly acknowledge these rights. This acknowledgement extends to the work of Lori Wallace.

 

Q: May I teach FSR and other modalities? 

 

A: Only if expressly invited and signed to become a teacher of Career Ecology.  You are however welcome to refer interested parties to Career Ecology for FSR Certification Training.  All training is held on an “evergreen” basis (meaning it is always open and available to new students). 

 

Q: What resources are available from Career Ecology? 

 

A: As a Certified FSR Writer, you will be provided with materials including: 1) Up-to-date Templates, 2) Access to a shared folder of sample resumes as examples to aide your writing, 3) up-to-date Style Guide, 4) up-to-date LinkedIn Guide, 5) exclusive access to the LinkedIn Certified FSR Group.

Accountability 

 

Certified status as a Feng Shui Resume Writer is an indicator that an individual has completed a combination of defined education and experience. However, certification is not a guarantee or assurance of the competence or ability of any particular individual. 

 

Career Ecology does not warrant that the status granted as a FSR writer certifies a candidate’s competence or ability to advise individuals or clients using FSR. Furthermore, nothing about this certification is intended to replace, override, or conflict with licensing requirements for professionals, if any.

 

The FSR Agreement and the Policies and Procedures are subject to revisions. FSR reserves the right to require that all FSR writers sign an updated copy to remain in good standing, upon request. In addition, by signing The FSR Agreement, all FSR writers are subject to the most current version of the FSR Agreement (even if you have signed an older version).

 

In the event of violation of The FSR Agreement or the Policies and Procedures, Career Ecology shall review the facts and circumstances surrounding the alleged violation. If Career Ecology, at its sole discretion, finds that the actions were in violation of the terms and conditions or the spirit of the FSR Agreement or the Policies and Procedures, remedies may be requested and/or the designation as “Feng Shui Resume Writer” may be revoked, and any necessary legal action may be taken by Career Ecology or Lori Wallace. 

 

This Agreement shall be governed and interpreted by the laws of the State of California, USA, and all disputes arising from The FSR Agreement or the Policies and Procedure shall be addressed within the venue forum and jurisdiction of San Diego County, California. The prevailing party shall have the right to collect from the other party its reasonable costs and attorneys' fees incurred in enforcing this Agreement.

Privacy Policy (All Account, Service and Certification Users)

What information do we collect?

When registering for Career Ecology we ask for your name, phone number and email address. We do this in order to communicate with you and keep you updated on service and offerings.  We do not share or sell your private information to other parties; and this includes organizations that may have puchased services as part of outplacement contract. 

 

What do we use your information for?

The information we collect from you may be used in one of the following ways:

  • To improve our website:  we continually strive to improve our website offerings based on the information and feedback we receive from you.

  • To process transactions:  your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, other than for the express purpose of delivering the purchased product or service requested.

  • To send periodic emails:  the email address you provide for order processing, will only be used to send you information and updates pertaining to your account as well as relative product updates.

 

How do we protect your information?

Our site is secured with an SSL Certificate.  Commerce is managed through Stripe and subject to Stripe’s online security measures.  We do not share or sell your personal information.

Do we use cookies?

Career Ecology is delivered via the platform, Kajabi.  Kajabi uses cookies to improve the functionality and experience of the site.  Kajabi uses the following cookies:

  • Active Log-in Session so you don’t have to re-login.

  • Kajabi Affliliate Token tracks which affiliate has referred and offer purchase

  • Admin Bar Hidden tracks whether the user would like thier admin bar to be hidden.

Occasionally, at our discretion, we may include or offer third party products or services on our website. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

 

California Online Privacy Protection Act Compliance

Because we value your privacy we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. We therefore will not distribute your personal information to outside parties without your consent.

 

Childrens’ Online Privacy Protection Act Compliance

We are in compliance with the requirements of COPPA (Childrens’ Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 18 years old or older.
